Terms and Conditions for Neumo

Please read these Terms and Conditions ("Terms") carefully before using the Neumo mobile application (the "App") operated by Tāne Langton ("us," "we," or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

These Terms should be read in conjunction with our Privacy Policy.

1. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party.

2. In-App Purchases and Subscriptions

The App includes optional auto-renewing subscriptions to access premium features ("Premium Subscription").

a) General

All in-app purchases are made through the Apple App Store. As such, all billing and transaction processes are handled by Apple and are governed by the Apple App Store's terms and conditions. If you have any payment-related issues with an in-app purchase, you need to contact Apple directly.

b) Subscriptions

Payment for a Premium Subscription will be charged to your Apple ID account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

c) Managing and Canceling Subscriptions

You can manage and cancel your subscriptions at any time by going to your account settings in the App Store on your device after purchase. You can find instructions on how to do this on Apple's support page.

d) Refunds

You acknowledge and agree that all billing and transaction processes are handled by Apple. We do not have the ability to issue refunds. If you wish to request a refund for an in-app purchase, you must do so by contacting the Apple App Store directly.

3. Acceptable Use

You agree not to use the App for any purpose that is unlawful or prohibited by these Terms. You agree not to:

  • Reverse engineer, decompile, or disassemble the App.
  • Use the App in any way that could damage, disable, overburden, or impair our servers or networks.
  • Use the App to harass, abuse, or harm another person.
  • Attempt to gain unauthorized access to any part of the App or its related systems.

4. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Tāne Langton be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

6. Disclaimer of Warranties

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Effective Date." By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
